Court orders release of 34 inmates of Harsul jail on parole

Aurangabad, Oct 21:

A bench comprising Justice T V Nalawade and Justice M G Shevalikar of the Aurangabad Bench of Bombay High Court on Wednesday ordered the release of 34 inmates of Harsul Jail on emergency parole in seven days. The court also rejected the petition of three inmates.

Pleas of Raosaheb Kakde and Madhav Munjal and Milind Pandit were rejected. Kakde and Munjal were earlier on parole. However, they did not appear in jail after the end of their parole. The bench also rejected the plea of Pandit who is accused of rape.

The state government had decided on May 8, 2020 to release the inmates who have been sentenced to 7 years imprisonment on emergency parole to prevent the spread of Covid-19. Accordingly, the inmates had applied for parole leave. The Harsul prison administration had rejected the applications of some inmates.

According to the government resolution of May 8, the prisoner should have taken parole leave at least twice and returned to the jail on time. According to the prison administration, some of the petitioners have never been granted parole or have been granted parole once.

Hence their applications got rejected. Adv Rupesh Jaiswal, adv R J Nirmal and adv Madhukar Parjane represented the petitioners and adv M M Nerlikar and adv R D Sanap worked on behalf of the government.
