Government will be responsible for the death of patient due to lack of oxygen
Aurangabad, May 21:
Aurangabad division bench of Bombay High Court comprising
Justice Ravindra Ghuge and Justice B U Debalwad on Friday rectified the
previous order stating the now the government will be responsible if oxygen is
not supplied in ample quantity in the Aurangabad division, if the patient is
sent back if the oxygen is not available and if the patient dies due to lack of
oxygen.
In the order issued on May 19, the
bench stated that if the situation arises that the oxygen is not available,
then the secretary of the Food and Drug Administration (FDA) Saurabh Vijay and
four nodal officers will be personally held responsible. Hence, these officers
hence forth should supply the oxygen with responsibility. If the oxygen is not
supplied in ample quantity, these officers will be eligible for individual
action.
The divisional commissioner Sunil Kendrekar and chief public prosecutor D R
Kale requested that changes should be made in the order of May 19 regarding the
black marketing of the injections required for mucormycosis and other related
facts. Hence, the bench made the necessary changes in the order.
The bench ordered to issue notices
to the respondents following a plea to postpone the tri-yearly elections of the
Foundation Brake Workers’ union at Jalgaon. The hearing will be held on
Tuesday.
Amicus curie Adv Satyajeet Bora,
chief government pleader Kale, Adv Santosh Chapalgaonkar for Aurangabad
Municipal Corporation and others were present during the hearing.
Meanwhile, Adv Kale submitted a
memorandum to the court stating that the state government has placed an order
of 2,57,700 injections for curing Mucormycosis and it will be distributed soon
to the districts. Presently, the injections will be provided considering the
stock and the need. Similarly, the Mycormycosis patients have been included in
the Mahatma Phule Arogya Yojana.
