Chhatrapati Sambhajinagar: The Aurangabad bench of the Bombay High Court comprising Justice S G Mehere and Justice Shailesh Brahme on Monday ordered the MGM University and principal of JNEC to give the benefits of the 7th Pay Commission to the petitioners in-service and retired teaching and non-teaching staff of Jawaharlal Nehru College of Engineering (JNEC). The bench directed to implement the recommendations of the 7th Pay Commission and revise salaries, and provide arrears of in-service and retired teaching and non-teaching staff members within four months.

What was in petition?
Ashok Devisingh Pawar, president of JNEC Unit of Bharatiya Kamgar Sena and others, represented by adv V P Golewar, stated in the petition that the petitioners had been working in JNEC College for about 25 years.
The All India Council for Technical Education (AICTE), Delhi, issued a circular on March 1, 2019, implementing the recommendations of the 7th Pay Commission. The State Government accepted the AICTE recommendations on March 8, 2019. The Government framed the rules for the pay of non-teaching employees on September 7, 2019.
The petitioners made repeated representations to the college management and other high officials.
However, they were not taken into consideration. They were upset and filed the petition on depriving of benefits from 1 January 2016. Adv Golewar was represented by Adv S V Natu.

Appointments as per rules
The Maharashtra University Act was in force at that time. The management's defence was that the appointments of the petitioners were not made as per the rules. “However, the management had never objected to the appointments of the petitioners. Their appointments were made as per the rules. They have served for a long time. Therefore, their demands cannot be rejected now” the court said observing that they are eligible to get the benefits as per their request.
